Please read these Terms and Conditions of Use (“TOU”) carefully. You must agree to these TOUs before you are permitted to use or purchase any products offered by Trestian Ltd (“the Company”), based in the United Kingdom.

These Sites are owned and operated by Trestian Ltd (along with any affiliated websites, products, or other entities, collectively referred to as “Resources”). By accessing and utilizing the Sites, you (referred to as “you”, “your”, “user(s)”) signify your agreement to be bound by the terms and conditions set forth between you and Trestian Ltd, which govern your use of the Sites and any related information, materials, and recommendations.

Should you find yourself in disagreement with the stated Terms and Conditions, you are explicitly barred from using the Sites, and you must cease their use immediately.

Modifications to Terms and Conditions: Trestian Ltd (“us”, “we”, “our”) reserves the right to alter, augment, or replace these terms and conditions at any moment without prior notification. Such modifications become effective immediately upon posting. Your continued use of the Sites indicates your acceptance of the updated Terms and Conditions. If you are not in agreement with these Terms & Conditions, you are advised not to use the Sites, engage with their content, or make any purchases from us.

These include digital or downloadable resources, online courses, interactive or static websites, one-on-one or group coaching, classes, resources, workshops, or training, or access to any online private forums operated by Trestian Ltd (for any purpose used by “Participants”), non-digital or downloadable products such physical merchandise (purchased in British pounds and for use as “Physical Merchandise”); whether on a website hosted by Trestian Ltd or a third-party website such as an online course platform or any social media. (collectively “the Resources”).

If you do not agree with these TOU, you may not use the Resources or Physical Merchandise.

As used in these TOU, the term “Releasees” is defined to include the following: (i) Trestian Ltd, its subsidiaries, affiliated companies, owners, members, managers, directors, officers, past and present employees, agents, contractors, coaches, representatives, successors, and assigns (collectively “the Company”); (ii) any Company volunteers.

Updates will be incorporated into the Terms and Conditions as of the "Last Updated" date specified above. By using the Sites, you relinquish the right to receive individual notices of such changes. It is your responsibility to regularly check the updated Terms and Conditions to remain informed about the binding agreement you have consented to for ongoing use of the Sites.

Article 1: Scope of application

These general conditions of sale apply to all transactions concluded through the websites of the Trestian Ltd network. Is considered as "client" any natural or legal person making with the company Trestian Ltd an order validated via our secure payment platform, or by check or cash.

Article 1a: Age limit

Age restrictions apply: The company Trestian Ltd only accepts clients over 18 years old (for physical and electronic products) and over 18 years old (for services: coaching, workshops, seminars). We do our best to restrict access to our sites, products and services to minors. Even if the content of our products and services is not of a shocking nature, we prefer to target a mature audience capable of understanding the implications and responsibilities of the business world. Any subscriber to the newsletter who does not meet these criteria (age over 18) will be immediately deleted from our database as soon as this is brought to our attention. Likewise, any customer who does not meet these criteria will be immediately reimbursed and a return of the product (s) concerned will be required. The Resources are intended and only suitable for individuals aged 18 and above. The Company disclaims all liability for use by individuals under the age of 18, and those under 18 may not use the website or purchase any Resources.

Article 2: Order

All Sales are Final. Any order placed on a site belonging to the company Trestian Ltd implies full and unreserved acceptance of these general conditions of sale.

Article 3: Price

The prices are indicated in British Pounds all taxes excluded (at the rate of U.K. VAT 20%), excluding shipping and processing of your order. We reserve the right to modify prices, and add or remove bonuses and discounts at our sole discretion at any time. However, the price applied to an order will be announced at the time of the order.

Article 4: Payment

Payment is due immediately on the date of the order, including for pre-order products. You can pay by credit card. Cards issued by banks domiciled outside the U.K. must be international bank cards (Mastercard or Visa). We do not accept American Express. Secure online payment by credit card is made through the company Stripe. The information transmitted is encrypted by software in the rules of the art and cannot be read during transport over the network. Any guarantee as to the security of this system is entirely the responsibility of the company Stripe and cannot be attributed to us.

Article 5: Delivery

Delivery is made to the address you specified when placing your order (therefore, pay particular attention to the spelling of the address you enter and especially the postal code). The risks will be your responsibility from the date on which the ordered products have left our premises. However, in the event of a lost package, we will do everything necessary so that you still receive your product or that you are reimbursed according to your warranty.

Article 6: Refunds

We offer a 14-day refund policy for our digital products. To be eligible, the product must not be substantially used, and you must provide valid proof of purchase. Refunds are not available for change of mind, technical issues due to incompatibility, or misuse. To request a refund, email info@thegiftofbeingawoman.com with your order number and the reason for the request. Article 7: Termination

The Company may terminate your participation in the Resources at any time, without refund, if you breach any part of these TOU. In the event of cancellation or termination, you are no longer authorized to access the part of the Resources or Content affected by such cancellation or termination. The restrictions imposed on you in these TOUs concerning the Resources and their Content will still apply now and in the future, even after termination by you or the Company.

Article 8: Intellectual Property Rights

a. Content Ownership

The content found on the Company's website, third-party platforms hosting our Resources, and in our emails, including text, videos, audio recordings, training materials, graphics, images, and all other intellectual property, is owned by Trestian Ltd or our affiliates/licensors. This content is protected by copyright, trademark, and other intellectual property laws.

b. Your Limited License from the Company

When you access our digital Resources or Content, you become a licensee of Trestian Ltd. This license is revocable, non-transferable, and strictly for personal, non-commercial use. You're allowed to view, download, print, and use individual pages of our Resources and Content for personal educational purposes only. However, you cannot republish, reproduce, sell, or distribute this content, whether for free or commercially. By using our Resources or Content, you do not gain any ownership rights – these remain with the Company. Each purchase is intended for the sole use of one student only. Unauthorized use of any part of our Resources or Content is considered infringement, leading to cancellation of access without refund.

This means you may view, download, print, email, and use one copy of individual pages of the Resources and Content for your own personal educational purposes only.

To use any Resources or Content commercially or to share them, you must obtain our written consent. The trademarks and logos within our Resources or Content are our property unless stated otherwise. Their use without our written consent is strictly prohibited.

c. Unauthorized Use Penalties

Using materials from our Resources or Content without explicit permission is prohibited. If you engage in unauthorized use, you agree to pay damages of five times the total fees paid for the Resources, or a minimum of £5,000, in addition to potential legal action.

Violations of these Intellectual Property Rights could lead to irreparable harm to Trestian Ltd, and we may seek injunctive relief and other legal remedies in such cases.

d. Your License to Trestian Ltd; Use in Marketing

By submitting any material, like comments or posts, during the use of our Resources, you confirm you own these materials and are at least 18 years old. We may ask for your consent to use your submissions, including your name and image, for various purposes, like advertising. This means granting us rights to these materials without further permission or compensation to you. We may also request consent to use your materials, like photos or videos, for our marketing or other publications. By granting this consent, you allow us and authorized parties to use your likeness for various purposes without compensation, unless specifically agreed in writing.

e. Requesting Permission for Content Use

If Trestian Ltd deems your behavior violates these TOU, we may terminate your access and participation immediately.

Article 10: Termination

Trestian Ltd may end your access to the Resources without refund if you breach these TOU. Following termination, you can't access the affected Resources or Content. These TOU restrictions still apply post-termination.

Article 11: Personal Responsibility and Disclaimer

By engaging with the Resources, you acknowledge the inherent risks and assume full responsibility for any resulting harm or damage. You release Trestian Ltd from liability in such events, except in cases of gross negligence or intentional harm.

Participating does not establish any professional relationship with Trestian Ltd. The Resources offer information and education only and are not substitutes for professional advice. You are responsible for your own decisions and outcomes. The Company is not liable for your reliance on the Resources.

We make no guarantees about specific results or earnings from using the Resources.

Third-party links are independent of us, and we are not liable for their content or actions. You should investigate third parties thoroughly before engaging with them.

We strive for uninterrupted access to the Resources, but can't guarantee this. The information, products, and services we offer are provided "as is" without warranties. We are not liable for damages from using or being unable to use the Resources.

Article 12: Protection of personal data

Security for all personally identifiable information is extremely important to us. Unfortunately, no data transmission over the internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, The Company cannot ensure or warrant the security of any information you transmit via the Internet. Article 13: Legal Disputes

These Terms and Conditions of Use (TOU) will be governed by and interpreted in accordance with the laws of the United Kingdom, disregarding any principles of conflicts of law. In the event of any disputes arising from or relating to these TOU, the exclusive jurisdiction shall be the courts of London, UK. The initial step in resolving disputes is to engage in preliminary mediation. Should any dispute related to these TOU be resolved through negotiation, mediation, or litigation, the prevailing party is entitled to recover its legal fees and associated costs from the other party.

Article 14: Users Outside the United Kingdom

Trestian Ltd operates and manages the Resources from its offices within the UK. The Company does not claim that the materials in the Resources are suitable or available for use in locations outside the UK. Individuals who choose to access the Resources from other locations do so on their own initiative and are responsible for adhering to applicable local laws. This responsibility extends to the degree that which these local laws are applicable.

Article 15: Indemnification

You agree to protect, indemnify, and hold harmless Trestian Ltd and its directors, officers, agents, contractors, partners, successors, and employees from all liabilities, claims, losses, damages, costs, and expenses (including attorney fees). This indemnification applies if any of the following occurs: (i) you use the Resources or Content in a way that violates these TOU; (ii) you break any part of these TOU or any statement you've made in these TOU; (iii) you submit any content, comments, or materials to the Company’s website or any related third-party forum or site; (iv) you use any part of the Resources or Content in a way that results in a legal claim, except in cases where the claim is due to the Company's own content; or (v) you break any law or any terms of agreements with third parties.

Articel 16: Force Majeure

Trestian Ltd will not be considered in breach of this Agreement if unable to provide the Resources due to unforeseen and uncontrollable events, known as "Force Majeure Events." These include, but are not limited to, natural disasters, labour disputes, acts of God, public enemies, epidemics, pandemics, death, incapacitation of the Company, or any governmental law or order. If such an event occurs, we will notify you of our inability to provide the Resources and may propose a revised schedule, make other accommodations, or terminate the Agreement.

Article 17: General Provisions

This Agreement, including our Privacy and Cookie Policies which are incorporated herein, constitutes the entire agreement between the parties, and reflects a complete understanding of the parties concerning the subject matter.

If any provision of this Agreement is held invalid or unenforceable, the remainder of this Agreement will remain in full force and the invalid or unenforceable provision will be replaced by a valid or enforceable provision.

This agreement supersedes all prior written and oral representations.

If you do not agree with these TOUs, do not enter or use the Resources, Content, or Physical Merchandise.
